BALLOT TITLE REFERRED FOR MODIFICATION

Bosak and Kain v. Myers (S49915). Upon consideration by the court. Petitioners’ arguments that the Attorney General’s certified ballot title for Initiative Petition 9 (2004) does not comply substantially with ORS 250.035 are not well taken except as to the summary. The court accepts the Attorney General’s concession of error on the point and agrees that he should modify the summary. The ballot title is referred to the Attorney General for modification.

Delaney and Burt v. Myers and Farago et al (S50017). Upon consideration by the court. Petitioner’s request for oral argument is denied. Petitioner’s arguments that the Attorney General’s certified ballot title for Initiative Petition 20 (2004) does not comply substantially with ORS 250.035 are not well taken. The court certifies to the Secretary of State the Attorney General’s certified ballot title for the proposed measure.

PEITITON DISMISSED
McIntire and Hall v. Myers (S50127). Upon consideration by the court. Petitioners have filed a peition alleging that the Attorney General’s draft ballot title for Initiative Petition 25 (2004) fails in certain respects to comply substantially with the requirements of ORS 250.035. On its own motion, the court dismisses the petition for lack of jurisdiction. See ORS 250.085(2) (granting Supreme Court jurisdiction to review “ballot title * * * certified by the Attorney General” (emphasis added)).
